Appeal from Anniston City Court. Heard before Hon. Thomas W. Coleman, Jr, Tim Sharp was convicted of murder in the first degree, and he appeals.

The defendant was convicted of murder in the first degree and sentenced to suffer death. He denied the killing, and sought to show that other persons present committed the crime. The undisputed evidence was that at the time of the homicide the deceased, William Dillard and Jim Ashwood, were policemen of the city of Anniston, and that a warrant for the arrest of the’ defendant was delivered to them, and that between 11 and 12 o’clock in the day, to execute the process, they went to Tenth street, where defendant lived in an upstairs room.
