Plaintiff-appellant Cross Sound Ferry Services, Inc. (“Cross Sound”) appeals from a summary judgment entered in the United States District Court for the Eastern District of New York (Feuerstein, J.) in favor of defendant Town of East Hampton (“East Hampton” or the “Town”).
