Appeals (1) from a judgment of the County Court of Clinton County (Lewis, J.), rendered March 16, 1992, upon a verdict convicting defendant of the crimes of rape in the first degree, sodomy in the first degree and endangering the welfare of a child, and (2) by permission, from that part of an order of said court, entered November 16, 1992, which denied defendant’s motion pursuant to CPL 440.10 and 440.20 to vacate the *712judgment of conviction and to set aside the sentence following his conviction, without a hearing.
