This matter is before the Court on defendants’ motion for summary judgment. Plaintiff, Heritage Development of Minnesota, Inc., brought suit against defendants Donna Carlson, Caroline Dahl, Jeffrey Reinert, and Jeffrey O’Donnel, individually and in their official capacities as City Council members for the City of Lino Lakes, Minnesota, 1 claiming a violation of its due process rights, and alleging a cause of action pursuant to 42 U.S.C. § 1983.
