FINDINGS OF FACT AND CONCLUSIONS OF LAW

This action was commenced on June 15, 2006 by NipponKoa Insurance Company, Ltd. (“NipponKoa”) against Watkins Motor Lines, Inc. (“Watkins”), asserting that NipponKoa is the insurer of two shipments of laptop computers owned by Toshiba America Information Systems, Inc. (“TAIS”) that were lost while in the possession and control of Watkins. Watkins is a contract carrier within the meaning of the Carmack Amendment, 49 U.S.C. § 14706, and there is federal question jurisdiction, 28 U.S.C. § 1331. (Compl-¶ 1) All discovery in this action…
