1Per curiam
In this case we consider whether the Eleventh Amendment of the United States Constitution protects Nueces County from a suit brought in state district court by current and former employees of the Nueces County Sheriffs Department for claims arising under the federal Fair Labor Standards Act (FLSA). 29 U.S.C. §§ 201-219. We conclude that because Nueces County is not an arm of the state under Eleventh Amendment jurisprudence, it does not possess Eleventh Amendment immunity from claims brought in state court under the FLSA.
