John Allen Rich appeals his conviction on a charge of taking a motor vehicle without permission. He claims that the trial court erred (1) in denying his motion to dismiss for the failure of the State to prove a necessary element of the crime charged, and (2) in denying his motion to dismiss for violation of his right under Const, art. 1, § 9 and the fifth amendment to the United States Constitution not to be placed in jeopardy twice for the same offense. We reverse.
