This case presents error from the district court of Comanche county and is an action for the specific performance1 of a contract to convey realty. The parties will be referred to herein as they appeared in -the trial of the court.
On the 21st day of May, 1910, the plaintiff, P. G. Fullerton, filed in said court the following petition:
