This insurance coverage dispute arises out of an action commenced in this court on January 12, 2011, in which plaintiffs *437Yelena Neizvestny and Valeriy Neizvestny seek damages for personal injury allegedly sustained by plaintiff Yelena on August 20, 2010 as a result of a trip-and-fall on a sidewalk on Avenue U in Brooklyn. Initially, the defendants were S.M.M.B.
