The appellant Biese was convicted upon a trial by jury of the crime of bootlegging and sentenced by the court to a term in the penitentiary.

It is first contended that the information upon which the appellant was convicted does not state facts sufficient to constitute a crime. The charge against the appellant is in the following language:

“That on or about the 30th day of January, 1926, in the county of Stevens and state of Washington, the said Frank Riese, then and there being, did then and there wilfully, unlawfully and feloniously carry about with him for the purpose of the unlawful sale…
