ORDER

McDONALD, District Judge.

Came on to be heard the Respondent’s, W.J. Estelle, Jr., Director, Texas Department of Corrections, Motion to Dismiss and Answer. This is an action for a Writ of Habeas Corpus pursuant to Rule 22 of the Federal Rules of Appellate Procedure, 28 *26U.S.C. § 2241 et seq., 28 U.S.C. § 2254 et seq. Having considered the arguments of the parties and the applicable law, this Court is of the opinion that the Respondent’s Motion to Dismiss should be GRANTED.
