Bell, Justice.

This was a suit to enjoin tbe inclosing of a vacant tract of land, in violation of a covenant between the defendants5 predecessor and an alleged common grantor of the plaintiffs and the defendants,' whereby the tract would be kept open *558for the common use of adjacent owners. The jury returned a verdict in favor of the defendants, and the judgment overruling the plaintiffs’ motion for a new trial was reversed by this court on the ground that the verdict was without evidence to support it.
