An information was filed in tbe district court for Scott’s Bluff county, in which plaintiff in error was accused of murder in the first degree in killing Samuel D. Cox by shooting him with a pistol held by plaintiff in error. A jury trial was had, which resulted in a verdict of guilty of murder in the second degree, with recommendation that *690tbe extreme penalty of tbe law for that degree be inflicted.
