Plaintiffs in error, Mary Bivins and others, legal representa tives of the estate of Lee Bivins, deceased, were plaintiffs in the trial court and will be so designated here. Leon Goodman and Foy Proctor were defendants in the trial court and will be so referred to in this opinion. Suit was brought by plaintiffs to recover of defendants two third of the losses sustained in a partnership venture between Lee Bivins, Goodman and Proctor.
