Error to the Court o£ Civil Appeals, Fifth District, in an appeal from Dallas County. Action by the Huttig Sash & Door Co., and others, interveners, to establish the personal liability of Freeman as a partner in the Independent Lumber Co., a business closed out by a receivership. Plaintiffs had judgment. Freeman prosecuted error, and on affirmance obtained writ of error from the Supreme Court.

In this case we are called upon to determine the correctness of the decision of the Honorable Court of Civil Appeals for the Fifth District in affirming the judgment of the District Court of Dallas County whereby the plaintiff in error, Freeman, was held liable as a partner for certain debts of the Independent Lumber Company, a partnership engaged in the lumber business at Dallas, contracted both before and after his association with it.
