An information was filed in the circuit court of Warren County charging the defendant, Bernard William Johnson, with the unlawful delivery of a substance which he had represented to be a controlled substance, in violation of section 404 of the Controlled Substances Act. (Ill. Rev. Stat. 1979, ch. 56/2, par. 1404.) Following a jury trial, the defendant was found guilty and sentenced to a one-year term of probation.
