A jury in the circuit court of Williamson County found defendant, John Calcaterra, guilty of selling a non-narcotic substance under the representation that it was a narcotic, in violation of section 38 of the Uniform Narcotic Drug Act. (Ill. Rev. Stat. 1961, chap. 38, par. 22 — 40.) He was sentenced to the penitentiary for a term of three to ten years. A constitutional question gives us jurisdiction.
