— Respondent recovered judgment
■against the appellants in the Cooper circuit court on the twelfth day of November, 1885', from which defendants took an appeal to this court. The respondent at this term filed his motion asking for an affirmance of the judgment on the ground that appellants had failed to file with the clerk of this court a transcript of the record fifteen days before the commencement of this term, as by ■statute provided.
