Tbe evidence in tbis case established without dispute tbe existence of an indebtedness of tbe son individually, and of tbe partnership composed of himself and Wei-gel, to tbe plaintiff, in an amount greater than tbe stipulated value of tbe property involved. Tbe direct testimony was all to tbe effect that at tbe time of shipment from Chicago that property belonged part to tbe firm and part to Weigel, and none to Griswold, Jr. Tbe only evidence to overcome such proof of ownership was certain alleged declarations of tbe latter to tbe effect that be owned such property.
