In this case we issued an alternative writ of mandate to determine the propriety of the transfer by respondent Superior Court of Santa Clara County of an action filed by petitioner against real party, her former husband, in San Mateo County to establish a foreign judgment of divorce, for a modification of that judgment to award custody of the minor child of the parties to petitioner, and seeking temporary custody *421of said child and a restraining order against real party.
