Charles E. Peters, defendant in error, recovered a judgment for $174.75 against Levi A. Raven on an account for merchandise sold and delivered to one Grage. The position of defendant in error is that on May 1, 1906, Grage owed him a balance of account amounting to $186.25; that on that date he presented the account to Grage, who sent him to Raven with the account for payment. Peters then went to Raven with the statement of account and informed him that Grage had sent bim and directed him to present to Raven all his bills and to mail to Raven all statements every month.
