The defendant was charged by information with the crime of murder in the second degree, the charging part of the information being as follows:
“He, said George H. Diebold, in the county of King, state of Washington, on the 5th day of March A. D. 1928, while unlawfully and feloniously engaged in taking and withdrawing from the scene of taking an automobile without the permission of one J. S. Pendleton, the owner thereof, did then and there unlawfully and feloniously, without excuse and justification operate and drive said automobile into, against and over the body of one Louise Lang, a human…
