MEMORANDUM OPINION

(October 16, 2002)

THIS MATTER came before the Court on Plaintiffs action for declaratory judgment. Defendants moved to dismiss and/or for summary judgment pursuant to Rules 7, 10, 12, and 56 of the Federal Rules of Civil Procedure and Rule 56.1 of the Local Rules of Civil Procedure and supported by affidavits and various discovery documents. Plaintiff never responded to Defendants’ motion.
