Appeal from the St. Louis County Circuit Court. — Hon. Rudolph Hiezel, Judge. To satisfy the statutes of frauds there must be not only a delivery of the goods, but also an actual receipt and acceptance of the same by the buyer. And this-acceptance can be proved only by clear and unequivocal acts on the part of the buyer, which acts must be independent of the proof of the contract.

Appeal from the St. Louis County Circuit Court. — Hon. Rudolph Hiezel, Judge. The petition contained two counts. The issues on the second one were found for defendant, from which no appeal was taken. It will not be further noticed here.
