The within action to recover for the wrongful death of plaintiff’s intestate was commenced in June, 1945, against the defendants, Mayal Realty Company, Inc., and Julius Weiss, doing business as Weiss Pulp Produce Company, and issue was joined by the filing of their answers on June 27, 1945, and June 29,1945. Thereafter on January 22,1947, exactly two years from date of decedent’s death, the plaintiff served a notice of motion for leave to bring in John J. Meenan, Inc., the appellant here as an additional defendant and for leave to issue and serve a supplemental summons and amended complaint…
