In a negligence action to recover damages for personal injuries, the plaintiff appeals from a judgment of the Supreme Court, Nassau County (McCaffrey, J.), entered April 23, 1986, which, after a jury trial on the issue of liability, is in favor of the defendants and against him.

Ordered that the judgment is modified, on the law, by (1) deleting the provisions thereof which are in favor of the defendants Paul Prudente and Peter Prudente on the issue of liability, and (2) severing the action as against those defendants and granting a new trial on the issue of the apportionment of the plaintiff’s…
