Petitioners 1 seek review of the Federal Energy Regulatory Commission’s (“Commission”) interpretation of this court’s decision in Tenneco Oil Co. v. FERC, 571 F.2d 834 (5th Cir.), cert. dismissed, 439 U.S. 801, 99 S.Ct. 43, 58 L.Ed.2d 94 (1978). In Tenneco, this court reversed that part of the Commission’s rate order in Opinion No. 749, 2 requiring the waiver of a refund credit by producers to obtain higher rates.
