The Virginia Railway and Power Company filed its petition with the State Corporation Commission, praying for relief from the obligation imposed upon it by the franchise granted to it and its predecessors by the city of Portsmouth, requiring the company to pay the entire-cost of paving and repaving between the rails of its tracks, and for two feet on the sides thereof. The franchise to the present company, granted in July, 1913, provides that at any time after a period of ten years from the date of the franchise, upon notice from the city council, the company should do the specified *57paving.…
