The appellants, Thomas H. Torian and Inez Torian, by their petition and amended petition, which they filed in the McCracken circuit court,- against the appellees, S. B. Caldwell, Cecil Reed, George W. Houser and William Schmaus, alleged, in substance, that S. B.
