This case is before this Court on remand from the Supreme Court of North Carolina. In our initial decision in this matter, we held that North Carolina law did not permit Jerry's Shell, LLC ("Jerry's Shell") to appear pro sein an administrative hearing before the Division of Motor Vehicles ("DMV") regarding its alleged violation of N.C. Gen.Stat. § 20-183.8C(d) and that, consequently, a new hearing was required in which it would be represented by legal counsel.
