From the middle of March, 1923, until May 17, 1928, when he resigned, plaintiff was employed by the defendant as a traveling salesman, and was paid a commission on all goods-sold by him and delivered during the term of his employment. The question to be determined here is whether the plaintiff is also entitled to commissions on goods purchased through him for future delivery, and which were not delivered until after he had tendered his resignation. The answer to that question depends entirely upon the nature of the contract between the parties. They are not in accord as to its terms.
