Appellant brought suit in the court below against appellee on a promissory note, and caused attachment to issue and to be levied upon a brick store house and lot in Marlin, which were then the property of appellee. The latter claimed the property as his place of business, and hence as a part of his homestead.
In September, 1884, appellee and one Pringle as partners were doing business in the house in controversy, in one room of which they sold dry goods, etc., and in the other they kept a saloon. On the twentieth of that month they made an assignment. The assignee…
