TORRUELLA, Circuit Judge.

On October 15, 2003, plaintiff Scott M. Epstein (“Epstein”) filed a ten-count complaint against Defendant C.R. Bard, Inc. (“Bard”) 1 in the Suffolk County Superior Court, requesting damages arising from Bard’s alleged breach of contract and infringement of Epstein’s intellectual property rights. Bard removed the case to the United States District Court for the District of Massachusetts. On July 19, 2004, the district court dismissed Counts Two through Eight and Count Ten.
