WESTENHAVER, District Judge.

This is a patent infringement suit. Plaintiff declares on two United States letters patent: First, 1,133,251, issued to Roy E. Adams, March 30, 1915; and, second, reissue 16,-200, issued to Joseph D. Adams and others, November 3, 1925. Of the first patent, claims 5, 6, 9, 12, 15, 20, 22, 23, 26, 31, 32, 35, 38, and 41 only are put in issue. As to the second patent, claims 9,13, and 15 only are put in issue. As to the first, the defenses are invalidity and noninfringement; as to the second, defendant admits infringement,- but contests validity. No issue is made as…
