The plaintiff, Mary McEvoy, seventy-two years of age, sued her son-in-law Eobert S. Brown, claiming she was attacked or injured by the dog of the defendant, by reason of its running into or against her in such a manner that she fell or was knocked from her back steps and broke her ankle. The dog belonged to the defendant son-in-law, and had been brought to the home of the plaintiff by her two grandsons, children of the defendant.
