This is an appeal from a judgment discharging alternative writ of prohibition an’d denying petition for a peremptory writ.

On September 22, 1964, a complaint was issued charging Dulsky with two violations of section 11225, Health and Safety Code. On September 30, he appeared alone in the municipal court and entered a plea of guilty upon which he was ordered to pay a fine of $500. Later the same day (September 30, 1964) Dulsky returned to court with counsel, at which time he was allowed to withdraw his plea of guilty; the case was continued for plea to October 9, 1964, at his request.
