MEMORANDUM
CONABOY, District Judge.
Petitioner Gary Lee Rock, presently incarcerated in the State Correctional Institu tion at Huntingdon, Pennsylvania (SCIHuntingdon), filed this action, through his counsel, on October 9, 1981 seeking a writ of habeas corpus pursuant to 28 U.S.C. § 2254(a) (1966). 1 His petition requests this Court to set aside his May, 1978 criminal conviction in the Court of Common Pleas of Franklin County, Pennsylvania, of two counts of first degree murder and six counts of attempted murder.
