OPINION AND ORDER

CONABOY, District Judge.

1. INTRODUCTION

This action is grounded upon a petition for a writ of habeas corpus pursuant to 28 U.S.C. § 2254(d). Gary Lee Rock is currently incarcerated on the basis of Pennsylvania state court convictions for first-degree murder and attempted murder.
