Cross appeals from an order of the Supreme Court at Special Term, entered October 13, 1976 in Ulster County, which denied defendants’ motion to dismiss the complaint for failure to state a cause of action and denied plaintiff’s cross motion to strike the answer and to grant summary judgment on the second cause of action. Plaintiff was engaged by the Town of Esopus from 1963 to 1975. By annual appointment he was at first designated a part-time Constable, but in later years the title became that of a part-time patrolman. He was separated from the position without a hearing in January of 1975…
