1, 2. Upon the trial of the case in the court below the accused introduced no evidence, and thus obtained the right to open and conclude the argument to the jury. At the conclusion of the evidence one of his counsel addressed the jury at some length; after which counsel for the State announced that he did not desire to argue the case. One of the counsel for the accused, who had not addressed the jury, thereupon approached the judge and privately stated that he desired to argue the case and wished the court to know that he insisted upon it as a legal right of the…
