OPINION OF THE COURT

GARTH, Circuit Judge.

Frazier Gibson is a prisoner in the New Jersey prison system. He brought the action from which this appeal is taken under 42 U.S.C. § 1983. Gibson alleged that his confinement under solitary conditions as a result of New Jersey’s lack of prison housing, violated his constitutional rights.

Prior to a hearing on the merits of Gibson’s claims, he was removed from solitary confinement. He then amended his complaint, deleting his claim for injunctive relief and he sought damages both for his confinement in Trenton State Prison under isolated conditions and…
