BLAIR, Justice.

This litigation arose as follows: Ap-pellee J. M. Roberts owned an interest in an oil and gas lease on a 1.6-acre tract of land in the East Texas oil field in Rusk county, and applied for a permit to drill a second well thereon, which the Railroad ’ Commission denied on December 17, 1934. On the same date, Roberts appealed to the district court of Travis county, seeking to set aside the order as being unreasonable and unjust.
