Neis Martenson has been a victim of a recurring insanity since the year 1896, when he was first committed to an asylum in this state. He was committed and discharged several times. For some time prior to June 10, 1912, he had been employed as a laborer and section boss by the Oregon-Washington Railway & Navigation Company. He had accumulated and had on deposit in a local bank in Tacoma about $700. For a long time, he had made his home at a hotel kept by the appellant. About June 17, 1912, he again became ill.
