This is an appeal from a decree of the chancery court of Humphreys county overruling a motion to dissolve a preliminary injunction.

The facts out of which this litigation arose as shown by the bill of complaint and answers, which by agreement were considered as the affidavits of the respective parties, and also by the oral testimony offered at the hearing of the motion to dissolve the injunction, are substantially as follows: During the year 1919 appellee James A.
