J. W. McCoplin brought this suit against the Burk-King Oil Company and William Schmidt and Levi McCaskill, to re cover an amount alleged to be due for drilling a well for oil and gas on property owned by tbe Oil Company. It was alleged that about January 6, 1920, tbe plaintiff and tbe Oil Company entered into a contract for sucb drilling; that subsequent to tbe date of sucb contract and prior to tbe completion of tbe well tbe defendants Schmidt and MeCaskill entered into a written agreement with plaintiff whereby they agreed to become personally liable for tbe payment of any amount already…
