This is an action pursuant to 42 U.S.C. § 1983, challenging the constitutionality of 22 NYCRR § 520.9(a), which sets forth the standards for admission to the New York State bar without examination. Specifically, plaintiff disputes the rule’s requirement for five years of experience in lieu of successful completion of the bar examination, insofar as it fails to credit as “actual practice” the time spent in the performance of legal services by New York State employees admitted to the bars of other states.
