It is insisted that the city of Taylor had authority to permit closing and vest exclusive control of that portion of Doak street involved herein in the railroad company for 15 years by virtue of chapter 152, Acts 33d Leg., approved April 7, ,1913 (carried into Rev. Stat. 1925 as articles 1018 to 1020), but this act is invalid in so far as it permits the surrender by a city, whether by contract or otherwise, of its legislative powers and duties, or which amount to an abdication of its governmental functions or of its police power, and because of the constitutional inhibition against…
