Plaintiffs William and Sharon Mays, husband and wife, appeal from two district court rulings which overruled their motions for a new trial. Plaintiffs’ first motion for a new trial was predicated upon defense counsel’s alleged misconduct during trial in repeatedly violating a limine ruling by the district court. After the district court overruled this motion and the case was on appeal, plaintiffs moved to vacate the district court’s prior ruling and judgment, claiming they were entitled to a new trial due to newly discovered evidence.
