I. INTRODUCTION

The matter before the Court is the “Plaintiffs Motion for Summary Judgment” (the “Plaintiffs Motion”) filed by the plaintiff Robert Nickse (“Nickse”) and *510the opposition thereto (the “Opposition”) filed by the defendant Jane C. Daniel (the “Debtor”).
