In a proceeding for leave to serve a late notice of claim pursuant to General Municipal Law § 50-e, the City of New York and the New York City Transit Authority appeal from an order of the Supreme Court, Kings County (Solomon, J.), dated April 22, 2005, which granted the petition.

Ordered that the order is modified, on the law, by deleting the provision thereof granting that branch of the petition which was for leave to serve a late notice of claim against the City of New York and substituting therefor a provision denying that *604branch of the petition; as so modified, the order is affirmed, with…
